Terms and Conditions

In order for you (the client) to get the most out of our sessions/program and to ensure that we are on the same page, please take the time to read this.

What’s within this agreement

These terms and conditions apply to all services provided by Leela founder of Clarity of Presence ( “The Coach”)  to any individual or organisation (“The client”) and constitute the contract for the service to be provided by Leela founder of Clarity of Presence for the client.

Coaching – helps the client to make changes to their lives through increasing awareness of themselves and others. Including any type of coaching, including life coaching, personal coaching, executive coaching and business coaching for clients.

Mentoring – provides advice and guidance, based on experience

Consulting – covers any form of diagnosing and solving problems and business support

Training – includes all forms of development with predefined objectives and learning pathways

What’s outside this agreement

Counselling , psychotherapy, trauma resolution and recovery – professional medical or psychological support

Signposting

There may be occasions when your coach may recommend to the client that they seek an alternative service more suited to their current needs. In this event will fully discuss the reasons for the recommendation with the client. It is the client’s sole responsibility to decide whether to follow the recommendation and your coach does not accept any liability for the outcome of any decisions the client chooses to make.

Coaching Disclaimer:

In committing to coaching session with your coach at clarity of presence:

  • You understand that the coaching services you will be receiving from your Coach are not offered as a substitute for professional mental health care or medical care and are not intended to diagnose, treat or cure any mental health or medical conditions. You also understand that your Coach is not acting as a mental health counsellor or a medical professional.
  • For legal purposes, you understand that coaching is currently an unregulated industry.
  • You understand and agree that you are fully responsible for your well-being during your coaching sessions and subsequently, including your choices and decisions.
  • You understand that coaching is not a substitute for counselling, psychotherapy, psychoanalysis, mental health care, or substance abuse treatment, and you will not use it in place of any form of therapy.
  • You understand that all comments, Ideas, training offered by your Coach are solely for the purpose of aiding you in achieving the defined goals you create with your Coach. You have the ability to give your informed consent, and hereby give such consent to your coach to assist you in achieving such goals and understand that results are not guaranteed.
  • You understand that the results you achieve, depend very much on you and your engagement, openness, effort and time investment in the process and you take total responsibility for your results and associated results.
  • You understand that to the extent our work together involves personal development, career, or business, your Coach is not promising outcomes included but not limited to trauma recovery, personal introspection, increased personal happiness, career progression, increase clientele, profitability and/or business success.
  • I understand that the use of technology is not always secure and I accept the risks of confidentiality in the use of email, text, phone, Skype and other technology. 

Waiver

I hereby release, waive, acquit and forever discharge my coach, any agents, successors, assigns, personal representatives, executors, heirs and employees from every claim, suit action, demand or right to compensation for damages I may claim to have or that I may have arising out of acts or omissions by myself or by my Coach as a result of the advice given by my Coach or otherwise resulting from the coaching relationship contemplated by this agreement.

I further declare and represent that no promise, inducement or agreement not expressed in this agreement has been made to me to sign this agreement. This agreement shall bind my heirs, executors, personal representatives, successors, assigns, and agents.

Fees

Fees are payable in advance of each session unless otherwise agreed. Where payment has not been received by your coach in advance of a coaching session your coach is not obliged to provide the session.

In return for the fees payable by the client (or by a third party on their behalf), your coach agrees to provide the service as described in services and in accordance with the terms and conditions set out.

The client agrees to pay fees for the service on the terms and conditions set out (in situations where a third party pays the fees, the third party counts as an agent acting on behalf of the client).

Payment terms

Fees can be paid online using paypal, through this platform you are also able to pay by debit or credit card as provided in the payment portal on clarity of presence. Receipts and/or invoices are available, and when the client requests receipts, they will be sent by e-mail.

Session Cancellation and Rearranging Sessions.

  • If the client needs to cancel or rearrange a coaching session, meeting or any form of support session, at least 48 hours’ notice is required to carry forward the unused session free of any additional charge. Where less that 48 hours’ notice no refunds will be given to clients for unused coaching session unless 48 hour’s notice has been given.
  • In exceptional circumstances, your coach may need to rearrange a session. In these circumstances your coach will use reasonable endeavours to provide a mutually satisfactory alternative appointment with the client.

Punctuality

If the client should arrive late to the session, the time may be deducted from your appointment and refunds cannot be made. In an event the coach arrives late to any coaching session or meeting your coach will use reasonable endeavours to provide a satisfactory response to make up any lost time

Additional Sessions

Your coach may agree to provide additional coaching sessions after completion of the initial agreed session(s). These terms and conditions will apply to any additional sessions so provided and the Per Session Fee will remain the same as originally agreed except where your coach notifies the client in writing by letter or e-mail of a change to the Fee or to any other term or condition in accordance with the section in these terms and conditions.

Between Sessions

Your coach may assign the client tasks or exercises to complete between coaching sessions. There is no obligation on the client to complete these items of ‘homework’, but not doing so may slow the client’s progress in achieving desired business or personal outcomes.

The client may contact the coach by e-mail between sessions to seek clarification regarding tasks given or for administrative purposes (e.g. where a client needs to rearrange a coaching session or make a payment). Additional coaching can also be provided between sessions but there will be an additional charge for this. Your coach will always advise a client in advance if the nature of a client’s contact is likely to incur an additional charge and no such charges will be imposed without the client’s agreement.

Confidentiality

 Your coach will respect the client’s privacy and seek written permission before disclosing they are a client.

Personal or business information supplied to your coach by the client in coaching sessions or any type of business meeting or discussion will be treated as confidential. No information will be disclosed to a third party without the client’s prior permission, except where required by law or if you report child abuse, elder abuse or neglect or threaten to harm yourself or someone else, you understand that necessary actions may be taken and your confidentiality agreement may be limited in this capacity.

Early Termination

In exceptional circumstances, such as illness or unavailability due to bereavement or other commitments, inappropriate behaviour by the client, actual or potential conflict of interest, or other reasons, your coach can decide to terminate the service to the client early or refuse or be unable to provide further coaching sessions to the client. In such a circumstance the client will be given reasonable notice of termination by your coach where practicable and will be refunded any advance payments made for coaching sessions not yet provided.
